By accessing or using Guide&Hold ("Service"), operated by Precision Operations Consulting LLC, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including tour and experience operators ("Operators") and their guests ("Guests").
Guide&Hold is a loyalty and retention platform operated by Precision Operations Consulting LLC that allows Operators to create and manage loyalty programs for their Guests. Guests enroll in programs and receive rewards through email and SMS communications.
Operators must register for an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information during registration.
When Guests enroll in a loyalty program, they may optionally provide a mobile phone number and consent to receive automated text messages. These messages include enrollment confirmations, reward notifications, milestone updates, and win-back reminders. Message frequency varies. Message and data rates may apply. Guests may opt out at any time by replying STOP. Reply HELP for assistance.
You agree not to use the Service for any unlawful purpose, to send unsolicited messages, to violate any applicable laws or regulations, or to interfere with the operation of the Service. Operators are responsible for ensuring guest data is collected and used in compliance with applicable laws.
Operators may use the Service on a subscription basis. Plans are billed monthly. All plans include a 30-day money-back guarantee. If you are not satisfied within the first 30 days of your subscription, contact us at support@guideandhold.com for a full refund. Precision Operations Consulting LLC reserves the right to change pricing with reasonable notice.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We collect and process personal data in accordance with our Privacy Policy.
The Service and its original content, features, and functionality are owned by Precision Operations Consulting LLC and are protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.
The Service is provided "as is" without warranties of any kind, either express or implied. Precision Operations Consulting LLC does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
To the maximum extent permitted by law, Precision Operations Consulting LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may cancel your account at any time. Upon termination, your right to use the Service will immediately cease.
We may update these Terms from time to time. We will notify you of significant changes by email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.
